1Acceptance of these terms

These Terms & Conditions ("Terms") are a binding agreement between you and Debitova, a brand of The Nelson M Group LLC ("Debitova," "we," "us"). They govern your use of debitova.com and related services, including email and text-message programs (the "Services"). By using the Services or submitting a form, you agree to these Terms, our Privacy Policy, and, if you opt in to texts, our SMS Terms. Disagree with any part of them? Then please do not use the Services.

2What Debitova is, and is not

Debitova is an information service. We publish general, plain-language information about everyday money topics such as budgeting, saving, bills, paychecks, and bank statements, and let visitors opt in to related updates. We do not offer loans, credit, bank accounts, or investments, give personal financial advice, or match or refer people to financial companies, and we will not share your details with banks, lenders, credit or investment companies, comparison sites, lead-generation companies, or any other third-party partners.

• Decisions about your money are yours. Reading our content does not obligate you to do anything.
• Your bank, the company you deal with, or a qualified professional you choose, not Debitova, is responsible for your accounts and any product terms.
• Results vary by person and situation. We never guarantee that you will save any amount or reach any particular result.

3Eligibility

You may use the Services only if you are 18 or over, are in the United States, and are able to agree to a binding contract. Information you submit must be about you, or about a person who has authorized you to submit it.

4Your information and accuracy

You agree to give accurate and current information and to update it if it changes. You may only provide a mobile number that you own or are authorized to use. If your number changes or is reassigned, please reply STOP from the old number or contact us so that we do not message someone else.

5Communications and text-message consent

If you opt in, you agree that we may contact you by email and, if you check the applicable boxes, by automated text messages as outlined in the SMS Terms. Consent to texts is optional, is not a condition of purchase or of using the Services, and may be withdrawn at any time by replying STOP. Message frequency varies. Message and data rates may apply. 6Text messaging: rates, frequency, STOP and HELP

Message and data rates may apply. Message frequency may vary (up to about 8 messages a month, depending on the topics you choose). Text START to join, or opt in with the form on our Get Started or text updates page. Consent is not a condition of purchase or of using the Services.

• STOP: Reply STOP to any message to opt out (STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT also work). You will get one confirmation text and then no more messages.
• HELP: Reply HELP to any message for help, or contact us by email at [email protected] or by phone at 877-265-1667.

Mobile information and opt-in data are not sold or shared with third parties or affiliates for marketing or promotional purposes. See the Privacy Policy and SMS Terms.

7Acceptable use

You must not: (a) enter false or misleading details, or another person's details; (b) use the Services for anything unlawful, fraudulent, or abusive; (c) interfere with the Services or try to gain access you are not allowed; (d) submit forms with bots or other automated tools; (e) copy, scrape, or resell our content without our permission; or (f) pretend to be someone else. We may suspend or end your access if you do any of these.

8Third-party organizations and links

Organizations, programs, and products mentioned on or linked from the Services (say government agencies, consumer groups, or banks) are third-party operations. No product, plan, or provider is endorsed by us, and we have no responsibility for the conduct, content, or results of those third parties. Your relationship with any bank or financial company is between you and them.

9Intellectual property

The Services, including the Debitova name, logo, text, graphics, and design, are owned by us or our licensors and covered by intellectual property laws. Your license to view and use the Services is limited, revocable, non-exclusive, and non-transferable, and is for personal, non-commercial purposes. Site photographs are used under their respective free-use licenses.

10Disclaimers

The services and content come "as is" and "as available," without express or implied warranties such as merchantability, fitness for a particular purpose, accuracy, and non-infringement. We cannot warrant that the services will be uninterrupted, error-free, or secure, nor that a message will be delivered or delivered on time.

Debitova does not provide financial, legal, or tax advice, and makes no representation about any savings amount, financial result, or product.

11Limitation of liability

To the fullest extent permitted by law, Debitova and The Nelson M Group LLC, and their members, managers, officers, employees, and agents, will not be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, among them loss of profits, data, or goodwill, that arise from your use of (or inability to use) the services or from a financial decision you make or do not make, and our total liability for any claim relating to the services will not exceed one hundred U.S. dollars ($100).

Certain jurisdictions do not permit some limitations, so part of the above may not apply to you. These Terms do not limit any liability that the law does not allow to be limited.

12Indemnification

You agree to hold The Nelson M Group LLC, its affiliates, and its personnel harmless, and to indemnify them, for claims, damages, and expenses (appropriate attorneys' fees included) arising from your violation of these Terms, from misuse of the Services, or from giving a phone number or other data that you were not authorized to supply.

13Disputes, governing law, and arbitration

Informal resolution first. Start by writing to us at [email protected] and let us try to resolve it within 30 days.

Binding arbitration. Excluding small-claims matters and claims for injunctive relief for intellectual-property misuse, any dispute between you and Debitova or The Nelson M Group LLC about these Terms or the Services is to be resolved by final and binding individual arbitration under the American Arbitration Association's Consumer Arbitration Rules. You may elect to hold it in your county of residence or by video or phone. The arbitrator may grant individual relief equal to what a court could, and judgment can be entered in any court of competent jurisdiction.

Class-action waiver. Both you and Debitova agree, as far as the law permits, to pursue claims individually only, never as a plaintiff or member of a class, collective, or representative action.

Opt-out. Arbitration is optional if, within 30 days of first accepting these Terms, you email [email protected] with the subject "Arbitration Opt-Out" and your name and mobile number.

Governing law. The Federal Arbitration Act and the law of the state in which The Nelson M Group LLC has its principal place of business apply to these Terms, regardless of conflict-of-law rules. Where the arbitration clause does not apply, the state and federal courts in that state have exclusive jurisdiction.

14Termination

You may stop using the Services at any time, and may opt out of messages by replying STOP. We may suspend or terminate access at our discretion, including for violations of these Terms. Sections that by their nature should survive (including disclaimers, limitation of liability, indemnification, and disputes) will survive termination.

15Changes

We can amend these Terms by posting a new version with a new "Last updated" date; if you hold using the Services after the effective date, you accept the amended Terms. We will give legally required notification of material changes.

16General

These Terms, the Privacy Policy, and the SMS Terms make up the whole agreement between you and us on this subject. An unenforceable part does not affect the remainder, and our not enforcing a provision is not a waiver of it. You may not assign these Terms without our consent. We may assign them in connection with a merger or sale of the business.
